These Terms govern use of this marketing website only. Any actual engagement for Scan To Listen installation or managed services will be governed by a separate written agreement between Scan To Listen LLC and the client venue. Nothing on this Site constitutes a binding service contract.
The Scan To Listen service is designed to distribute audio exclusively within the physical premises of the venue, using local wireless technologies including Wi-Fi networking and Bluetooth broadcast (such as Auracast). The service does not transmit audio over the public internet or beyond the physical boundaries of the venue.
Venue operators are solely responsible for ensuring that their use of the Scan To Listen service complies with all applicable copyright, public performance, and licensing laws. This includes ensuring that any audio content distributed through the service is covered by appropriate authorizations — such as public performance licenses (e.g., BMI, ASCAP, SESAC), broadcast or cable agreements, or other applicable rights — and that such authorizations permit the distribution method used.
Scan To Listen LLC does not own, select, or control the audio content distributed by venue operators and is not responsible for any copyright infringement or licensing violations arising from a venue's use of the service. By using the Scan To Listen service, venue operators represent and warrant that they have the legal right to distribute all audio content through the service in the manner in which they use it.
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Davidson County, Tennessee.
We may update these Terms from time to time. Changes take effect when posted to this page, with the effective date updated accordingly. Continued use of the Site after any changes constitutes acceptance of the revised Terms.
